By accessing our website or engaging Gulf Coast Concepts for any Services, you agree to be bound by these Terms. If you do not agree, please do not use our website or engage our Services.

Gulf Coast Concepts reserves the right to refuse service to anyone at our sole discretion.

Gulf Coast Concepts provides creative execution services to entrepreneurs and small businesses in Southwest Florida and beyond. Services may include but are not limited to:

• Brand identity and strategy development
• Website design and development
• Social media content creation
• MVP and prototype building
• Business registration guidance
• Operations consulting and process improvement
• SOP creation and organizational efficiency
• Creative strategy consulting sessions

The specific scope of services, deliverables, fees, timeline, and payment terms for each engagement will be outlined in a separate Project Agreement or Invoice (“Agreement”). These Terms apply alongside any such Agreement.

• You are responsible for providing Gulf Coast Concepts with accurate, complete, and timely information, materials, and feedback necessary to complete the Services.
• You are responsible for reviewing and approving deliverables in a timely manner.
• You agree that delays caused by late feedback, missing materials, or lack of communication may affect project timelines and are not the responsibility of Gulf Coast Concepts.
• You are responsible for all decisions made based on work product, strategy, or advice provided by Gulf Coast Concepts.
• You are responsible for ensuring you have the legal right to use any materials, content, or assets you provide to Gulf Coast Concepts for use in your project.

Gulf Coast Concepts uses AI tools transparently as part of our creative and operational process. These tools are used alongside real, hands-on skill and experience to deliver faster, higher-quality results. The use of AI tools does not diminish the originality, effort, or value of the work delivered. By engaging our Services, you acknowledge and accept this approach.

• Upon receipt of full payment, you will own the final deliverables created specifically for your project as outlined in your Agreement.
• Gulf Coast Concepts retains the right to display completed work in our portfolio, blog, and marketing materials unless otherwise agreed upon in writing.
• Gulf Coast Concepts retains ownership of any tools, templates, frameworks, or proprietary processes used in delivering the Services that are not created exclusively for your project.
• You represent that any materials you provide to us do not infringe on the intellectual property rights of any third party.

• Gulf Coast Concepts will keep confidential any sensitive business information you share during your engagement and will not disclose it to third parties without your written consent, except as required by law.
• You agree to keep confidential any proprietary methods, processes, or materials used by Gulf Coast Concepts that are shared during your engagement.

Gulf Coast Concepts provides creative execution services designed to support the growth and development of your business. We do not guarantee specific business outcomes, revenue results, or growth metrics as a result of our Services. Gulf Coast Concepts makes no warranties, express or implied, regarding the Services or any work product delivered.

• Gulf Coast Concepts is not liable for any actions, decisions, or outcomes resulting from your use of our Services or deliverables.
• Gulf Coast Concepts is not liable for any damages, including direct, indirect, incidental, consequential, or punitive damages, arising from your engagement with us or use of our website.
• Our total liability for any claim arising from our Services shall not exceed the total fees paid by you for the specific project giving rise to the claim.

• Payment terms, amounts, and schedules will be outlined in your Project Agreement or Invoice.
• You are responsible for timely payment of all agreed-upon fees.
• Gulf Coast Concepts reserves the right to pause or suspend work on a project in the event of non-payment.
• All fees are in US Dollars unless otherwise specified.

• Either party may terminate a project engagement with written notice (email is acceptable) for any reason.
• In the event of early termination by the client, you may be responsible for payment of fees proportional to the work completed at the time of termination, as outlined in your Agreement.
• Gulf Coast Concepts reserves the right to terminate an engagement at any time if a client acts in bad faith, provides false information, or engages in conduct that is abusive or harmful.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Lee County, Florida.

These Terms, together with any applicable Project Agreement or Invoice, constitute the entire agreement between you and Gulf Coast Concepts regarding the Services and supersede any prior agreements or understandings.

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of our website or Services after any changes constitutes your acceptance of the revised Terms.
